Update from DFT:

Important update for Hauliers on market access rules from 1 January 2021 if there is no Free Trade Agreement
We appreciate current circumstances are very challenging for the haulage sector. We are working to ensure that the appropriate arrangements are in place for hauliers after the Transition Period ends. We said we would keep you updated on changes that affect you.

Latest position
We continue to work hard to finalise an overall trade agreement with the EU. That agreement should allow UK hauliers to carry goods to, from and through the EU with no restrictions. Both sides continue to prepare for a situation where a trade agreement has not been concluded by 31 December.

On 10 December, the European Commission published a proposal for a Regulation covering basic connectivity with regard to both road freight, and road passenger transport. The EU Council has since approved the text with some changes (including the addition of some cabotage rights) and if the European Parliament endorses the text then it will be formally adopted. This is expected to happen shortly.

If the Regulation is adopted in its current form, it will allow UK hauliers to make unlimited journeys to or from the EU until 30 June 2021, and some additional movements until 31 May:

Until 28 Feb UK hauliers will be allowed to make two additional movements which can be either cross-trade*, cabotage** or one of each;
between 1 March and 31 May hauliers will be allowed to make 1 additional movement which can be either cross-trade* or cabotage**.
This will cover the majority of journeys performed by UK hauliers to EU countries. If an overall trade agreement with the EU is not concluded we will be working to put in place longer-term arrangements with the EU or Member States.

The EU Regulation will not allow transit to third countries. If an overall trade agreement is not concluded, and if you need to transit the EU to a third country you will need an ECMT permit. If you have been allocated an annual ECMT permit you have until 23.59 today to pay for the permit.

What action should I take?
Check your journeys are covered by the EU Regulation and consider in particular whether you need a permit for transit in January.
We will be able to issue short term permits for these journeys. If you have not been allocated an annual ECMT permit then you should contact the DVSA at [email protected]

Permits will only be issued for journeys to the countries listed below and you may be asked to provide evidence of previous trips or future contracts. While we assess demand, we will only issue permits to cover journeys that commence in January and you must return completed ECMT logbooks within two weeks of the expiry of the permit. Arrangements for access after January will be confirmed in the New Year.

We are not able at this stage to issue short term permits for additional cross-trade journeys: hauliers must therefore operate within the rules of the EU Regulation and may also make use of the permit-free movements allowed under the ECMT regime - see pages 11 and 13 of the ECMT User Guide.

Third countries where you may need an ECMT permit to transit the EU in January:

Albania, Armenia, Azerbaijan, Belarus, Bosnia and Herzegovina, Georgia, Kazakhstan, Liechtenstein, North Macedonia, Moldova, Montenegro, Norway, Serbia, Switzerland, Tunisia, Turkey, Ukraine***



* Cross-trade is moving goods between two EU Member States, e.g taking a load from Paris to Brussels.

**Cabotage is moving goods between two points within one EU Member State e.g. from Paris to Lille.

*** We expect the contingency regulation to be adopted by both Norway and Liechtenstein but this is not guaranteed before 1 January 2021.

With Tier 4 restrictions now in place in certain parts of the UK I have just received the below on what this means for HGV Operators.

Vehicle testing in English Tier 4 areas

The Prime Minister has announced new Tier 4 restrictions in England to control the spread of coronavirus.

From Sunday 20 December London, together with parts of the South East and East of England will enter Tier 4. Tier 4 restrictions will remain in place until the next formal Government review on 30 December.

What this means for vehicle operators
Heavy vehicle testing can continue under all Tiers with COVID-19 secure measures in place.

We will continue to provide the vehicle standards assessors needed to test heavy goods vehicles (HGVs) and public service vehicles (PSVs) safely.

You and DVSA staff must wear a face covering in all indoor public areas unless you have a reasonable excuse not to.

You should continue to manage the regular maintenance and inspection schedule for your vehicles and trailers. This is a legal requirement under your operator’s licence.

Getting tests
You can now use our find a test centre service to see whether ATFs have test slots available.

Vocational driving and theory tests
The Government has confirmed that vocational theory and practical test services will be suspended in alert Tier 4 areas from 20 December.

Vocational trainers will be automatically refunded for practical tests. Candidates who booked their own test will receive a new test time and date by email.

We will email anyone who has booked a test and is affected by this to let them know the theory test is on hold and that they will need to reschedule it by visiting https://www.gov.uk/change-theory-test.

If you booked your pupil's theory test you will need to log into the booking system and rearrange their test for a new date and time.

Driver CPC
In-vehicle driver CPC training must not take place in Tier 4, but remote training can continue. Classroom training should only take place where essential.

Enforcement activity
We will continue our enforcement work to protect you from unsafe drivers and vehicles on our roads.

We’ll also continue to work remotely to support drivers and operators to follow guidance and legislation and, where appropriate, improve their driver and vehicle standards.

Just received the below from Department for Transport with regards to moving goods to the EU post Brexit:

Important information for hauliers moving goods to the EU from 1 January 2021

Dear Haulier,

There are now 2 weeks left until the processes for moving goods in and out of the EU change.

With or without a free trade agreement we will be leaving the customs union and single market. Customs declarations will need to be made and hauliers will be expected to carry the right documents to get across the border.

I know many of you are acutely aware of the changes coming and are taking steps to be ready, but it is vital your customers, those whose goods you move, also take the right actions and give you and your drivers the right paperwork. If not, it will be your company and your staff who suffer as a result of traders’ lack of preparation.

There are a number of actions you can take today. From January 1, every haulier moving goods into the EU will need the correct driver, vehicle, cargo and customs documents.

Every vehicle will need:
- From your customers:
A Movement Reference Number (MRN) for standard customs procedures
A Transit Accompanying Document (TAD) for goods moving under transit
A Temporary Admission (ATA) Carnet, or a Transport Internationaux Routiers (TIR) Carnet to goods moving using these customs processes
Additional paperwork, for example an Export Health Certificate or Catch Certificate, for plant, animal or restricted goods
- Motor Insurance Green Card(s)
- A GB Sticker on the rear of the vehicle and trailers if your company is GB based (even if the number plate includes the GB identifier under the EU logo).
Your customer will also need to make an Entry Summary Declaration (safety and security declaration) into the Import Control System (ICS) of the EU country you are travelling to.

Every driver will need:
- A driver Certificate of Professional Competence (CPC)
- Passport
- An Operator Licence and UK Licence for the Community
- A driving licence, and potentially an International Driving Permit for some EU countries.

On Thursday 10 December, the EU published a proposed temporary contingency measure which would, if a Free Trade Agreement (FTA) is not concluded, allow UK hauliers to continue to perform some journeys to and from the EU without the need for any permits. If approved, the Commission’s proposal allows UK hauliers the right to perform journeys to and from destinations in the EU for 6 months – until 30 June.

It would also allow UK hauliers to transit the Republic of Ireland on journeys to and from Northern Ireland, but it would not provide transit to third countries, cabotage or cross-trade. All hauliers who applied for ECMT permits for 2021 have received a response and have until 23 December to decide whether they wish to take those permits up.

The Haulier Handbook explains all the requirements for moving goods and how to use each of the EU country systems. I urge you to read it carefully.

We have also introduced the ‘Check an HGV is Ready’ service. It will help you check whether you have the right documents to cross the border. It will be compulsory for any HGV using the crossing in Kent - and using the service will give drivers a valid Kent Access Permit (KAP).

Your business will take the brunt of a lack of preparedness by your customers. This could be in the form of delays or entirely wasted journeys if your consignments are rejected. I urge you to be clear with your customers that they must equip you with accurately and fully completed information to ensure smooth passage.
